INTRODUCTION

To you who are visiting this page

This is my digital portfolio. It originated as an assessment component of the Business Law and Innovation Law specialisation on the law programme in Gothenburg, in which we spend the year collecting our work in a portfolio that reflects our development as lawyers.

The format was not prescribed. But since the portfolio had to take digital form anyway, it was a short step to building something that went a little further. I saw an opportunity to gather my work in one place and to present it in a way that allows anyone who is interested to see how I actually think and work as a lawyer, while also getting a sense of who I am.

The works on this site are divided into three categories, each capturing a particular way of approaching legal problems. That is also the order I recommend as a way in. You can follow my work chronologically or by the roles I have taken on, but the categories give the clearest picture of what I am actually doing in each text.

You are welcome to read, and do not hesitate to get in touch if anything raises questions.

These works fall under the classification of application – they are created by taking up a construct and, by applying it, reflecting on the current law and producing a rigorous and relatively precise action plan.

Artificial intelligence
subject or object?

This paper examines the legal question of whether artificial intelligence should be understood as a subject or an object, and argues that the question itself is methodologically misconceived. Taking Scandinavian functionalism and Alf Ross's classic analysis of legal concepts as analytical intermediaries as its starting point, it problematises the idea that the ontological status of AI should be decisive for legal regulation.

Through analogies, methodological reasoning and parallels in legal theory, it shows how a focus on classification risks diverting attention from the chains of human action and relationships of responsibility in which the normative relevance actually lies. The aim is to show how the law can analyse AI without ascribing an independent normative status to technical artefacts.
